All we ask in return is that you follow a few simple rules. So before you create your first page here at ePinoy.com, please be sure you have read, and understood, these Terms and Conditions. Members who do not follow rules and regulations could find their entire web site removed and/or deleted, most often without prior notice. The interpretation of these guidelines is at the sole discretion of ePinoy.com: ePinoy.com is capable of giving away free web space thanks to the sponsorship of our advertisers. In return, each page that you create will have an advertising banner automatically inserted into it (one banner per page at the top of the viewable browser window). You may not remove, resize so as to render invisible or unreadable, or otherwise block any of the banners that ePinoy.com inserts onto your web pages; You must provide a valid email address from an ISP, not a free email address such as Yahoo, Hotmail or Gmail. A "gateway" site is one which serves only as an entrance to the actual site located on a non-ePinoy.com server; Your page should be in English, French or any of the languages specified as a choice when you sign up; Your page should be active - that is, it is either receiving 'hits' or is being updated/posted to. Sites that either receive no hits or are not updated over a period of 30 days will be considered 'inactive' and may be removed by ePinoy.com to make room for other users; You may not use your web space to provide material, or links to material, that is grossly offensive to the Web community. Hate propaganda; Anything illegal including, but not limited to, illegal software, warez or hacked software, serial numbers, mail fraud, or pyramid schemes; Material insulting, or that could be considered defamatory or libelous, to other persons, institutions or companies; Material that exploits children; Material which attempts to collect personal information about users; Materials infringing the intellectual property rights of third parties (including, but not limited to, trademarks, domain names, personality rights, names of individuals, publicity rights, logos, graphics, designs, films, and music), those which allow the circumvention of revenue rightfully due to a manufacturer for the sale of a product or the disabling of installed copy protected devices, and all other forms of cracker utilities, are strictly forbidden; You may not use your web space for 'data warehousing' ; that is, using our space as storage for large files which are only linked from other sites; The following list of file types are the only file types permitted on ePinoy.com members sites. All other file types are not permitted: js, swf, au, snd, mid, midi, ram, wav, gif, jpg, wrl, vrml, css, html, htm, rtf, png, psd, ico, doc, php, sql, cgi; Any other files located by ePinoy.com will be automatically deleted. The maximum upload file size is 5MB. The limit for jpegs is 1 MB, for gifs is 1MB and for HTML or Text files is 0.5MB. Your site has to have its content consisting of mostly text, sites having mostly Photo Albums and graphics will not be accepted and deleted if found to break this rule. You may not use unsolicited email to promote your site; ePinoy.com reserves the right to block or delete any site due to inappropriate behavior by the webmaster towards ePinoy.com, its staff or its users, which has been validated on public or private forums; You may not copy or reproduce any page, image or other content without the express prior consent of the original copyright owner of that content; By joining ePinoy.com you automatically receive our ePinoy.com E-News newsletter and occasional special promotions. You can unsubscribe from the newsletter by following the given instructions within the newsletter. Free hosting: By submitting a web page to ePinoy.com or any other web page hosting service on The ePinoy.com Network, you grant ePinoy.com a royalty-free, nonexclusive, worldwide, unrestricted license to use, copy, transmit, publicly display, publicly perform, create compilations including, and distribute such web page, and any associated Content, for the limited purposes of publishing and promoting the user's web page in connection with the particular service with which the user has chosen to have the web page hosted, and for publishing and promoting such web page elsewhere within the ePinoy.com Network. Such license shall apply with respect to any form, media, or technology now known or later developed. This term will extend only for the duration of the user's membership with the particular ePinoy.com service. In the event that such membership is terminated, ePinoy.com will relinquish all rights to the user's Content following the duration of any applicable promotional activities ongoing at the time the membership is terminated. Subscriber agrees that no adult content or adult dating sites or illegal content of any kind will be placed on any website in the network. - Subscriber agrees to adhere to the ePinoy.com Acceptable Use Policy. - Subscriber agrees not to engage in activity that violates federal, state or local laws applicable to the service terms described herein. - ePinoy.com reserves the right to discontinue service to any subscriber it deems, in its sole discretion, violates any condition of service including the Acceptable Use Policy and Terms of Services. - Subscriber agrees to indemnify and hold harmless ePinoy.com and the employees and agents of ePinoy.com against any losses, claims, damages, liabilities, penalties, actions, proceedings or judgments (collectively, "Losses") to which an Indemnified Party may become subject and which Losses arise out of, or relate to this Agreement or Subscriber's use of the Services and Products, and will reimburse an Indemnified Party for all legal and other expenses, including reasonable attorneys' fees incurred by such Indemnified Party in connection with investigating, defending or settling any Loss whether or not in connection with pending or threatened litigation in which such Indemnified Party is a party. - ePinoy.com SHALL NOT BE LIABLE FOR (i) ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS OR LOSS OF REVENUE RESULTING FROM THE USE OF ePinoy.com'S SERVICES AND PRODUCTS BY SUBSCRIBER OR ANY THIRD PARTIES, OR (ii) ANY LOSS OF DATA RESULTING FROM DELAYS, NONDELIVERIES, MISDELIVERIES OR SERVICE INTERRUPTIONS WE PROVIDE THE SERVICES AND PRODUCTS AS IS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED ePinoy.com DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE SUBSCRIBER SHALL BE SOLELY RESPONSIBLE FOR THE SELECTION, USE AND SUITABILITY OF THE SERVICES AND PRODUCTS AND ePinoy.com SHALL HAVE NO LIABILITY THEREFORE. - Notices. Unless otherwise specified herein, any notices or other communications required or permitted hereunder shall be sufficiently given if in writing and delivered personally or sent by facsimile transmission, internationally recognized overnight courier, registered or certified mail, to the address or facsimile number of Subscriber as set forth in the Service Descriptions or as set forth below. Such notices or other communications shall be deemed received (i) on the date delivered, if delivered personally, (ii) on the date that return confirmation is received, if sent by facsimile, (iii) on the business day (or, if international, on the second business day) after being sent by an internationally recognized overnight air courier or (iv) five days after being sent, if sent by first class registered mail, return receipt requested. - Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the country where ePinoy resides, without regard to choice of law provisions that would cause the application of the law of another jurisdiction. We reserve the right to deny any IP address from signing up for our service. We reserve the right to stop our free web hosting service at any time, for any reason. By becoming a Member, you agree to all the above terms.
